Reinstating of custody
A parent can (temporarily) be suspended from the custody. This can be done, for example, if the child has a guardian if the parent is unable to exercise the custody. If circumstances have changed then the parent can ask to be reinstated in the custody.
Application for reinstatement of custody
The parent who had custody can submit an application for reinstatement of the custody to the Guardianship Council CN if the child is registered in the Caribbean Netherlands. This can be done during consultation hours of the Guardianship Council CN or you can schedule an appointment by telephone with the Guardianship Council at your location.
What you need to bring for an application for reinstatement in custody is all personal and contact details of the parent(s), guardian, and child(ren) involved and the guardianship order.
If the parent who had custody is unable to come to the Guardianship Council during consultation hours, then you can schedule an appointment with the Guardianship Council by telephone at your location.
The application is then considered. A council investigator from the Guardianship Council CN investigates the parent who wants to be reinstated in custody. If there are no objections to reinstating the parent(s) in their custody and the temporary guardian agrees to the application then the parent can submit the application to the court.
The court invites the guardian and parent(s) to a gathering at the court: the court hearing. During the court hearing, the court issues a ruling or the court announces when the ruling is due to follow.
