Registration in the hospitality sector not always according to standards of the BES Personal Data Protection Act

The Commissie toezicht Bescherming Persoonsgegevens BES (CBP BES), charged with the supervision and enforcement of the Personal Data Protection Act BES, has established that the registration of personal data at, among others, food and drinking establishments does not always go according to the set standards.

The registration of personal data is mandatory in the context of source and contact tracing to limit the spread of the coronavirus.

Organisations should ensure that personal data are adequately protected. This means that unauthorised persons may not gain access to these data. The CBP BES has received signals that various food an drinking establishments work with one list on which all personal data of visitors are registered. The data of others are then visible to every registering visitor. The CBP BES makes an urgent appeal to hospitality organisations to organise the registration in a different way.

How do you register in the right way?

It is important that each customer or table is registered on a separate form, so that others do not have access to phone numbers and names of others. You can do this digitally or by hardcopy. The organisation should ensure that they protect the data properly both technically and organisationally. This prevents unauthorised persons from gaining access to these data. Unauthorised persons can also be employees of the organisation. The person responsible for the organisation must ensure this.

The registered personal data should not be kept longer than 14 days after registration. After the 14 days, the organisation must remove the personal data from the organisation's records.
