Permits

To make sure that the interests indicated in the Maritime management law BES are protected, a permit obligation is applicable for some activities. In a permit activities are allowed for which the permit obligation is applicable. Besides the Maritime management law BES you also have to comply with the local rules and permit obligations. The local government can advise you in this and take your permit request into consideration.

Permits in the framework of the Maritime management law BES are issued by the  Rijkswaterstaat. The petition and granting of a permit proceeds according to the following steps:

Step 1

You send an e-mail to Rijkswaterstaat and we will contact you as soon as possible to discuss your wishes with you. If a permit is necessary, you will receive from Rijkswaterstaat a petition form with the specifications with which the petition must comply.

Step 2

You can submit a draft petition form to Rijkswaterstaat for an evaluation in an early stage, to verify whether the specifications are being complied with.

Step 3

You submit the official petition, including all necessary documents.

Step 4

Rijkswaterstaat evaluates whether the petition contains sufficient information to take a decision on. As soon as the petition complies with the requirements, Rijkswaterstaat announces in local papers that the petition has been received, in so far this is legally prescribed.

Step 5

In consultation with other ministries and the local insular government, Rijkswaterstaat makes a decision regarding the petition. If this decision leads to limitations of the petition, you get the possibility to react upon it. Rijkswaterstaat involves this reaction to the final decision.

Step 6

Rijkswaterstaat publishes the decision (including the associated petition). Other parties can object within a period of six weeks. If you have received a permit, you should make sure that your construction or activity complies with the requirements as stated in the permit.
