What can I do if my injuries happen to have become worse?
If your injuries appear to or have become worse after you have had a decision from the Schadefonds regarding your application, you can submit an additional application.
For an additional application, the Schadefonds requires medical documents which state that the injuries are worse than was taken into account in the first decision. The Schadefonds will then consider whether you will still receive a higher compensation payment. If your injuries have indeed become worse and a higher compensation payment therefore applies, the difference between the two amounts will be transferred to your account.
Two examples of a situation for which you can make an additional application:
- You have ultimately been treated for your psychological symptoms for longer than you took into account in the first decision.
- Your physical injuries appear to be worse than was taken into account during the first decision. Example: you had a root canal treatment and a lost tooth was put back. Later, it appears that the tooth is dead and still has to be extracted.
As a surviving relative, you can only submit an additional application for funeral costs and for damage if you suffer as a result of the loss of income from the deceased.
