Is it necessary to report the matter for a compensation payment from the Schadefonds?
No, a report is not always necessary for a compensation payment from the Schadefonds. If you have not reported the matter, it must however be clear from other documents what has happened. Sometimes notifying the police or a report from the Voogdijraad can be sufficient. This must indeed contain enough information about the crime, the reason and the circumstances.
The Schadefonds requires confidential information from someone who was not involved in what happened. The following are not sufficient in any case:
- only an own declaration from the victim
- witness statements which were taken a longer time after the incident and/or not reported to the police
- only medical information because it does not mention what the reason for the crime was or under what circumstances it took place. This also only mentions what the victim told to the care provider, this is not sufficient for our assessment.
